Acceptable Use Policy

This Acceptable Use Policy ("AUP") is maintained by PestMetry and governs your access to and use of the PestMetry software-as-a-service platform, website, mobile and web applications, APIs, and related services (collectively, the "Services"). It applies to every customer, authorized user, guest, administrator, and third party who accesses the Services on behalf of a customer account. This AUP is incorporated by reference into, and forms part of, the PestMetry Terms of Service. Capitalized terms used but not defined here have the meanings given to them in the Terms of Service.

PestMetry provides warehouse pest management and sanitation intelligence tools that unify facility mapping, pest incident records, sanitation activities, inspections, work orders, and related operational data. Because the Services are used to support food safety, compliance, and facility operations, customers and users are expected to behave lawfully, ethically, and in a manner that preserves the integrity, security, and availability of the platform for everyone who relies on it.

1. Your responsibility for use

Each customer is responsible for the acts and omissions of every user who accesses the Services under the customer's account, including employees, contractors, vendors, and third-party service providers granted access by the customer. Customers must ensure that all such users are aware of, and comply with, this AUP and applicable law. Violations by any user of a customer account may be treated as violations by the customer.

2. Prohibited activities

You may not use the Services, and you may not permit any user or third party to use the Services, to engage in any of the following:

• Violate any applicable law, regulation, ordinance, judicial order, or the legal rights of any person or entity, including laws relating to food safety, occupational health and safety, data protection, privacy, intellectual property, export controls, and consumer protection.
• Submit, transmit, store, or share content that is unlawful, fraudulent, defamatory, harassing, threatening, discriminatory, obscene, or otherwise objectionable, or that infringes or misappropriates the intellectual property or privacy rights of any person.
• Upload, submit, or transmit any content that you do not have the right to submit, or that violates any contractual, confidentiality, or fiduciary obligation.
• Impersonate any person or entity, misrepresent your affiliation with a person or entity, or use the Services in a way that is intended to deceive other users, auditors, regulators, or customers.
• Falsify, backdate, or knowingly misrepresent pest incident records, sanitation activities, inspection findings, work orders, corrective actions, or any other operational data submitted to the Services, including for the purpose of misleading auditors, regulators, insurers, or customers.
• Use the Services to defame, harass, or retaliate against any employee, contractor, inspector, auditor, or third party.
• Collect, store, or process personal data through the Services without a lawful basis and appropriate notices and safeguards, or use the Services to send unsolicited communications in violation of applicable anti-spam, marketing, or telemarketing laws.
• Submit content that contains sensitive categories of personal data (such as government identifiers, financial account numbers, payment card data, or health information) unless a specific feature is expressly designed for that purpose and you have all required consents and legal bases.

3. Security restrictions

To protect the Services and the customers who depend on them, you may not:

• Access, tamper with, or use non-public areas of the Services, PestMetry systems, or the technical delivery systems of PestMetry's providers.
• Probe, scan, or test the vulnerability of any PestMetry system or network, or breach or circumvent any security, authentication, or access control measure, except as expressly authorized in writing by PestMetry.
• Attempt to access data, accounts, facilities, or environments that do not belong to you or that you are not authorized to access.
• Upload, transmit, or introduce any virus, worm, ransomware, trojan, malware, or other malicious or harmful code, file, or script.
• Use the Services to attack, disrupt, degrade, or interfere with any user, host, network, or system, including through denial-of-service, brute-force, credential-stuffing, or similar activity.
• Share, resell, or transfer account credentials, API keys, or access tokens, or authenticate to the Services using another person's credentials without authorization.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying models, or non-public architecture of the Services, except to the extent this restriction is prohibited by applicable law.

4. Fair use of platform resources

The Services are shared infrastructure. To preserve reliability and performance for all customers, you may not:

• Use the Services in a manner that materially exceeds the intended use for warehouse pest management and sanitation intelligence, or that imposes an unreasonable or disproportionately large load on our infrastructure.
• Circumvent, disable, or attempt to exceed any documented plan limits, rate limits, storage limits, seat limits, or usage controls.
• Access the Services through automated means (including bots, scrapers, or scripts) other than through PestMetry-provided APIs, integrations, or features, and only in accordance with their documented terms and rate limits.
• Use the Services to build, train, or benchmark a competing product, or to copy features, functions, user interfaces, or other elements of the Services.
• Resell, sublicense, time-share, or make the Services available to third parties as a service bureau, except as expressly permitted in a written agreement with PestMetry.

5. Content standards

You are responsible for all content that you or your users submit, upload, or store in the Services, including facility blueprints, photographs, inspection notes, pest incident records, sanitation logs, work orders, and comments. You must have the necessary rights to submit that content and to grant PestMetry the rights required to host and process it in accordance with the Terms of Service. Content submitted to the Services must be accurate and appropriate for a professional food-safety and facility-operations context; the Services must not be used to store gratuitous, harmful, or unrelated content.

6. Third-party integrations and data

When you connect the Services to a third-party system (for example, an email provider, storage provider, identity provider, or partner integration), you are responsible for complying with the terms and policies of that third party and for ensuring that your use of the integration is authorized and lawful. You must not use PestMetry integrations to exfiltrate data in a manner that violates a third party's rights or applicable law, or to circumvent security controls of another system.

7. AI-assisted and automated features

Certain features of the Services may use artificial intelligence, machine learning, or other automated processing to assist with tasks such as blueprint digitization, data organization, or summarization. You must not rely on those outputs as the sole basis for regulatory, food-safety, health, safety, legal, or other decisions that require independent professional judgment. You are responsible for reviewing outputs before acting on them and for ensuring that any content you submit to an AI-assisted feature complies with this AUP and applicable law.

8. Reporting violations

If you become aware of a suspected violation of this AUP, including abuse of the Services, security incidents, or content that should be removed, please report it promptly to support@pestmetry.com. Please include enough information to allow us to identify and investigate the issue. We appreciate good-faith reports and treat them confidentially where appropriate.

9. Enforcement

PestMetry reserves the right, but does not undertake any obligation, to monitor use of the Services for compliance with this AUP. If we determine, in our reasonable discretion, that a customer or user has violated this AUP, we may take any of the following actions, with or without prior notice, based on the severity and circumstances of the violation:

• Request that the customer or user promptly cease the offending activity or remediate the underlying issue.
• Remove, restrict, or disable access to specific content, features, integrations, API keys, or user accounts.
• Suspend or throttle affected functionality in order to protect the Services, other customers, or third parties.
• Suspend or terminate the customer's subscription or account in accordance with the Terms of Service.
• Cooperate with law enforcement, regulators, or other authorities where required by law or where PestMetry believes in good faith that such cooperation is appropriate.

Where a violation creates an imminent risk to the security, integrity, or lawful operation of the Services or to third parties, PestMetry may act immediately and provide notice as soon as reasonably practicable. Failure to enforce this AUP in a particular instance does not waive our right to enforce it in any other instance.

10. Changes to this policy

PestMetry may update this AUP from time to time to reflect changes to the Services, applicable law, or industry practice. When we make material changes, we will update the effective date above and, where appropriate, provide notice through the Services or by other reasonable means. Your continued use of the Services after an update becomes effective constitutes your acceptance of the updated AUP.
